Seasonal Weight Limits
[Adopted 5-20-1993 as Ord. No. 93-06]

§ 158-28. Seasonal weight maximum.

    A. It shall be unlawful for any motor truck, motor vehicle, animal-drawn vehicle or team exceeding the registered gross weight of twenty-three thousand (23,000) pounds to pass over the following designated and posted town ways, town highways, improved third-class highways and bridges, or sections thereof, between November 1 and May 1 of each year.

    B. It shall be unlawful for any pickup truck exceeding the registered gross weight of ten thousand (10,000) pounds to pass over the designated and posted town ways, town highways, improved third-class highways and bridges, or sections thereof, between November I and May I of each year, as listed in Subsection A above.

§ 158-29. Special exceptions.

This Article shall apply to all motor trucks, motor vehicles, animal-drawn vehicles and teams, except the following:

    A. Any vehicle or combination of vehicles registered for a gross weight of twenty-three thousand (23,000) pounds or less, other than pickup trucks referenced in § 158-28B above.

    B. Any vehicle or combination of vehicles registered for a gross weight in excess of twenty-three thousand (23,000) pounds and traveling without a load other than tools or equipment necessary for the proper operation of the vehicle.

    C. Any vehicle engaged in highway operation, repair or maintenance under the direction of the Fort Fairfield Public Works Director.

    D. Any two-axle home heating fuel truck registered in excess of twenty-three thousand (23,000) pounds which has an exemption certificate issued by the Maine Department of Transportation.

    E. Any vehicle engaged in the transportation of bulk potatoes or bulk feed which is registered in excess of twenty-three thousand (23,000) pounds with an exemption certification issued

    by the Maine Department of Transportation carrying a partial load with a weight equal to or less than indicated on the exemption certification as documented by delivery slips or bills of lading accompanying the vehicle.

§ 158-30. Violations and penalties.

Any person, operator or owner of any such motor truck, motor vehicle, animal-drawn vehicle or team who violates this Article shall be guilty of a civil violation, and each violation, upon conviction, shall be punished by a fine not to exceed five hundred dollars ($500.).
