FORT FAIRFIELD PARKING REGULATIONS

ARTICLE IV

Stop Intersections

[Adopted ATM 3-21-1927 as Arl. 511

§ 158-16. Designated stop intersection.

Any motor vehicle entering Main Street from Bridge Street, or from the road leading to the passenger station of the Canadian Pacific Railway Company or from any private or public way between said Bridge Street and said road leading to said passenger station shall, before entering Main Street, be brought to a full stop, and until completing its turn into said Main Street, shall be driven under complete control.

§ 158-17. Violations and penalties.

Whoever, as driver of any motor vehicle, violates the provisions of this Article, shall be fined not less than two dollars ($2.) nor more than ten dollars ($10.), to be recovered by complaint to the use of the Town of Fort Fairfield.

§ 158-18. Signs.

The municipal officers shall cause signs bearing the word ''STOP'' or similar words to be prominently displayed so that they may be readily visible to drivers of motor vehicles entering Main Street from the public ways within the limits specified in § 158-16.

ARTICLE V

Stoplights

[Adopted ATM 3-20-1939 as Art. 271

§ 158-19. Procedure at stoplights.

All vehicles shall come to a stop and remain stopped on approaching the red stoplights now installed or any that may be hereafter installed until said light or lights change to green, except that it will be permissible for any vehicle to leave traffic to the right but not to enter said traffic with the red against said vehicle.

§ 158-20. Violations and penalties.

Any person violating this Article shall forfeit to the town a sum not to exceed ten dollars ($10.) for each and every offense, to be recovered by complaint to the use of said town.

ARTICLE VI

Motorcycles

[Adopted STM 9-14-1950]

§ 158-21. Speeds.

It shall be unlawful for anyone to operate a motor bicycle or motorcycle at a speed in excess of ten (10) miles per hour after 10:00 p.m., according to the time legally in effect in Fort Fairfield throughout the built-up portion of the town.

§ 158-22. Definitions.

As used in this Article, the following terms shall have the meanings indicated:

BUILT-UP PORTION - That area within said town defined by laws of the State of Maine

Revised Statutes, Chapter 19, Section 102E.

§ 158-23. Violations and penalties.

Any person who shall be guilty of the violation of the provisions of this Article shall forfeit and pay a fine of not more than fifty dollars ($50.) to be recovered to the use of the town with costs on conviction on complaint before the Judge of the Fort Fairfield Municipal Court.

§ 158-24. Nonresidents

No nonresident of the Town of Fort Fairfield, however, shall be subject to a penalty unless he or she violates the provisions of this Article after having been given due notice ot the provisions of this Article.

ARTICLE IX

Parking Regulations

[Adopted 6-29-1989 as Ord. No. 89-08]

§ 158-31. Obstruction of sidewalks and driveways.

The owner or operator of any motor vehicle found parked and left unattended so that any part of such vehicle obstructs a public sidewalk or private driveway shall be punished by a fine as provided in § 158-43.

§ 158-32. Blocking fire hydrants.

The owner or operator of any motor vehicle found parked and left unattended so that any part of such vehicle is within ten (10) feet of any town hydrant shall be punished by a fine as provided in § 158-43.

§ 158-33. Blocking fire house.

The owner or operator of any motor vehicle found parked and left unattended so that any part of such vehicle is obstructing the entrance or exit of the fire house shall be punished by a fine as provided in § 158- 43.

§ 158-34. Overnight parking restriction.

The owner or operator of any motor vehicle found parked and left unattended on any street between the hours of 2:00 a.m. and 6:00 a.m. shall be punished by a fine as provided in § 158-43.

§ 158-35. Parking close to curb.

The owner or operator of any motor vehicle shall park such vehicle on Main Street parallel with the edge of the roadway, headed in the direction of lawful traffic movement, and with the right-hand wheels of the vehicle within twelve (12) inches of the curb or edge of roadway. Violation of this section shall be punished by a fine as provided in § 158-43. 15809

§ 158-36. Main Street time limit parking; violations.

A. When signs are erected in each block giving notice thereof, no person shall park a motor vehicle upon Main Street for a longer period than so specified in that section.

B. Violation procedure.

(1) Whenever a motor vehicle is found stopped, standing or parked for a period of two (2) hours, signs being erected giving notice of the time limit allowed, the vehicle shall be in violation and each two (2) hours thereafter shall be a separate offense.

(2) The officer finding such vehicle shall take its registration number and any other information which may identify the owner and shall conspicuously affix to such vehicle a traffic citation, on a form provided by the town, for the registered owner to answer to the charge against him or her. The citation shall bear the time, date, place and officer's name. A stub containing the same information, along with the registration number of the offending vehicle, shall be retained by the Police Department, and it shall be prima facie evidence that the registered owner of the vehicle was the violator.

§ 158-37. Post office parking restrictions.

The owner or operator of any vehicle found parked or left unattended on Fort Hill Street located on the east side of the United States Post Office and Main Street located in front of the United States Post Office, for a continuous period of twenty (20) minutes during the hours from 7:00 a.m. and 5:00 p.m. of any day excepting Sundays and legal holidays shall be punished by a fine as provided in § 158-43.

§ 158-38. Winter parking restrictions.

The owner or operator of any motor vehicle found parked and left unattended upon any way for a continuous sixty-minute period between 12:00 midnight and 6:00 a.m., daylight saving time, at any day during the period from November I to April I each year shall be punished by a fine as provided in § 158-43 and/or subject to towing as provided in § 158-41.

§ 158-39. Designated handicapped parking; penalties.

The owner or operator of any motor vehicle found parked and left unattended in nated handicapped parking space and which does not bear a special registration plate or placard issued under 29 M.R.S.A. § 252, or similar plate issued by another state, shall be cited for a penalty of forty dollars ($40.).

§ 158-40. Municipal parking lots.

A. It shall be unlawful and a violation of this Article for any person to permit any motor vehicle owned by or under the control of such person to remain or stand in any municipal 15810 parking lot at any time unless such vehicle complies with the laws of the State of Maine made and established for the registration and inspection.

B. No person shall park any vehicle in any municipal parking lot in the Town of Fort Fairfield for a period exceeding the posted limit or, in the case of unposted lots, twenty-four (24) hours at any one (1) time.

C. For the purpose of this Article, "municipal parking lots" are hereby defined as lots of land controlled and set aside by the Town of Fort Fairfield as off-street parking areas for the parking of vehicles. Such areas are for public usage under regulations of this Article.

D. It shall be prima facie evidence that the registered owner of the vehicle was the violator and shall be punished by a fine provided in § 158-43 and subject to towing as provided in § 158-41.

§ 158-41. Emergency towing.

Vehicles left unattended in a public street or parking lot may be towed without giving prior notice upon order of the Chief of Police or his or her designee to an appropriate towing firm when such vehicles interfere with the town's ability to deal with emergency situations, including but not limited to the following:

A. Snow removal operations.

B. Fire-fighting operations.

C. Police activity, including maintaining civil order.

D. Highway services.

E. Utility services.

F. Ambulance services.

G. Traffic control or flow.

H. Municipal parking lots.

§ 158-42. Owner responsibility for towing fees and recovery.

The owner of a vehicle towed in compliance with § 158-41 shall be responsible for paying towing and storage cost to the towing firm and otherwise be responsible for recovering the vehicle from the place of impoundment.

§ 158-43. Violations and penalties.

A. Penalties for violations shall be as follows:

(1) First offense: seven dollars and fifty cents ($7.50).

(2) Second offense [less than one (1) year from last offense]: twelve dollars ($12.).

(3) Third offense [less than one (1) year from last offense]: thirty-five dollars ($35.).

(4) Illegal parking in a designated handicapped parking space: forty dollars ($40.).

B. Payment within seven (7) days of issuance of ticket will reduce payment by twenty-five percent (25%).

§ 158-44. Prosecution of violation.

If fines are not paid within thirty (30) days of violation, the legally listed owner of the motor vehicle that was noted as being illegally parked shall be issued a civil citation to Number Two (2) District Court in Presque Isle, Maine, and subject to a fine not to exceed twenty-five dollars ($25.) if adjudicated to having committed the offense alleged.

§ 158-45. Habitual offenders.

Any person who shall have committed more than six (6) offenses within the period of one (1) year may be designated by the Chief of Police to be an "habitual offender." The habitual offender shall be issued a civil citation to Number Two (2) District Court in Presque Isle, Maine, and subject to a fine not to exceed fifty dollars ($50.) if adjudicated to have committed the offense alleged.

§ 158-46. Enforcement.

The Chief of Police or designee of the Town of Fort Fairfield shall be responsible for enforcement of this Article. 15812
